Service

The terms that govern your access to Moni, an immersive AI chat, roleplay, and romance simulation experience operated by Loco Bayco Limited.

Important. Please read these Terms carefully. They explain how Moni works, how User Content is handled, and the rules that apply to purchases, safety, and account access.

01 / Agreement

These terms are the agreement between you and Moni.

These Terms of Service (the “Terms”) are a legal agreement between you and Loco Bayco Limited (“Loco Bayco”, “we”, “us”, or “our”) governing your access to and use of the Moni mobile application, website, software, content, and related services (together, the “Service”).

By downloading, accessing, or using the Service, or by selecting an option that indicates acceptance, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

These Terms apply to users in Taiwan, Hong Kong, and Macao, subject to mandatory rights and protections that cannot lawfully be excluded in your place of residence. The Service is currently offered in Traditional Chinese.

02 / Eligibility

Moni is for adults.

You must be at least 18 years old to use the Service. The Service is not directed to children and is not intended for anyone under 18. You must not access the Service if you are under 18, if you are legally prohibited from using it, or if your access has previously been suspended or terminated.

By using the Service, you represent that you meet the age requirement and that all information you provide is accurate. We may take reasonable measures to confirm age where necessary for safety, compliance, or platform requirements.

03 / Account access

Your access is connected to your device.

The Service currently uses your device ID to create or authenticate access automatically. Guest access is not available. Because access may depend on your device or device identifier, changing, resetting, losing, or replacing a device may affect your ability to access the same account or content.

You are responsible for keeping your device secure and for all activity carried out through your access to the Service. You must not share, sell, transfer, or attempt to obtain another person’s access credentials or device-linked account.

You may request account deletion through https://moni.locobayco.com/. Where the Service provides an in-app account-management feature, deletion will also be made available through that feature. A deletion request may require reasonable verification to protect your account and information.

04 / The service & AI

Moni is an entertainment experience, not a person.

Moni provides AI-generated character roleplay and chat for entertainment. The characters, messages, voices, images, and other responses presented through the Service are generated, assisted, or selected by automated systems and are not human statements or professional advice.

AI output can be inaccurate, incomplete, biased, repetitive, unexpected, or unsuitable for your situation. You should not rely on it for medical, mental-health, legal, financial, relationship, emergency, or other professional decisions. Do not treat a character as a real person, a therapist, a counsellor, a representative of Loco Bayco, or a source of verified facts.

Do not use the Service for emergencies, to diagnose or treat a condition, to make decisions about another person, or to request instructions that could facilitate harm, unlawful conduct, fraud, exploitation, or abuse. If you or someone else may be in immediate danger, contact local emergency services.

We may modify, suspend, restrict, or discontinue features, models, characters, content, or any part of the Service. We will use reasonable efforts to communicate material changes where required by law.

05 / User content

You can create characters, but you remain responsible for what you add.

5.1 What counts as User Content

“User Content” means content you submit, upload, create, configure, or make available through the Service, including AI character profiles, names, descriptions, prompts, images, audio, messages, and feedback. The Service does not provide user-to-user chat; interactions are with AI-generated characters.

5.2 Your rights and our licence

As between you and Loco Bayco, you retain any rights you have in your User Content. You grant Loco Bayco a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to host, store, reproduce, adapt, process, display, perform, distribute, and otherwise use your User Content only as reasonably necessary to operate, maintain, secure, improve, moderate, and promote the Service, and to comply with law. This licence ends when your User Content is deleted, except to the extent it is retained in backups, is needed to resolve disputes or comply with law, or has been incorporated into aggregated or anonymised material that cannot reasonably identify you.

You represent and warrant that you have all rights, permissions, and consents needed to submit the User Content and grant this licence. You must not upload another person’s image, voice, personal information, or likeness without an appropriate legal basis and permission. You must not use copyrighted, trademarked, confidential, or private material unless you are authorised to do so.

5.3 Moderation and removal

We may, but are not obligated to, review, filter, label, restrict, remove, disable access to, or preserve User Content and accounts. We may take action when content violates these Terms, our Child Safety Policy, platform requirements, or applicable law, or when action is reasonably necessary to protect users, the Service, or third parties.

We do not guarantee that moderation will detect every harmful, unlawful, or objectionable item. You should report content using the in-app feedback form or by emailing locobayco@outlook.com.

06 / Acceptable use

Use Moni lawfully and with care.

You must not, and must not encourage or help anyone else to:

  • use the Service if you are under 18, or help a minor access it;
  • create, upload, request, distribute, or promote child sexual abuse or exploitation material, grooming, sexualisation of minors, or any content that harms or endangers a child;
  • create or distribute non-consensual intimate imagery, sexual deepfakes, impersonation, harassment, threats, hate, violence, self-harm encouragement, or content that facilitates abuse;
  • use the Service to commit fraud, phishing, extortion, money laundering, illegal surveillance, or another unlawful act;
  • infringe privacy, publicity, intellectual-property, contractual, or other rights;
  • upload malware or interfere with the Service, its security, models, or infrastructure;
  • scrape, crawl, reverse engineer, decompile, disassemble, extract model weights or prompts, or bypass access, safety, age, rate, or payment controls, except to the extent a restriction cannot lawfully apply; or
  • use automated access, resale, benchmarking, or commercial exploitation without our prior written permission.

We may investigate suspected violations and cooperate with service providers, platform operators, regulators, or law enforcement where permitted or required by law.

07 / Purchases

In-app purchases are processed through the store you use.

7.1 Subscriptions and digital items

The Service may offer in-app purchases and subscriptions. Before purchase, the applicable product description, price, currency, billing period, renewal terms, and any trial or introductory offer will be shown in the Service or the relevant app store.

Subscriptions may renew automatically unless cancelled before the renewal deadline shown by the applicable store. You can manage or cancel a subscription through your Apple App Store or Google Play account, as applicable. Deleting the app does not necessarily cancel a subscription.

7.2 Billing and refunds

Apple or Google, as applicable, processes payment and may provide the billing, receipt, subscription, and refund interface. Loco Bayco does not receive or store your full payment-card details through the Service. Refunds are handled under the applicable Apple or Google refund rules and procedures, subject to mandatory consumer rights.

We may change prices or purchase terms with notice where required by law. A change will not alter a paid period already purchased unless the law or the store’s terms permit it.

08 / Intellectual property

Moni and its underlying work belong to Loco Bayco or its licensors.

The Service, including its software, design, branding, characters supplied by Loco Bayco, text, graphics, audio, models, selection and arrangement, and all related intellectual-property rights, is owned by Loco Bayco or its licensors. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

Subject to your compliance with these Terms, Loco Bayco grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Service on devices you own or control for your personal, non-commercial entertainment.

If you believe content in the Service infringes your rights, contact locobayco@outlook.com with the rights owner’s name, the relevant work, the location of the allegedly infringing material, and a good-faith explanation.

09 / Safety & moderation

Safety is part of the product.

We use content moderation and may use automated and human review to identify, restrict, and respond to content that violates our rules. You can report content through the in-app feedback form or by contacting locobayco@outlook.com. You may also block or restrict access to content or accounts where those controls are made available in the Service.

We may suspend or terminate access, remove characters or other content, restrict features, or take other proportionate action. We may preserve information and disclose it to appropriate authorities where required or permitted by law, including in relation to credible threats, fraud, exploitation, or child safety concerns.

10 / Disclaimers & liability

Use the Service with realistic expectations.

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not promise that it will be uninterrupted, secure, error-free, accurate, always available, compatible with every device, or free from harmful or objectionable content. We do not warrant that AI output will meet your needs or be suitable for any purpose.

You are responsible for your decisions and actions based on the Service, your User Content, your device, and your interactions with AI characters. We are not responsible for the conduct of other users, the acts or omissions of third-party providers, or content you choose to upload or rely on, except to the extent liability cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any non-waivable consumer right.

Subject to the preceding paragraph, Loco Bayco’s liability will be limited to the maximum extent permitted by applicable law. Any limitation will not apply where it is prohibited by law or would remove a mandatory consumer protection.

11 / Ending the service

You can stop using Moni at any time.

You may stop using the Service and request deletion of your account as described above. We may suspend or terminate your access if you breach these Terms, create risk for users or the Service, fail to pay amounts due, or if we are required to do so by law or a platform operator.

On termination, your licence to use the Service ends. Provisions that by their nature should survive termination will continue, including provisions concerning User Content licences to the extent stated, intellectual property, payment obligations, disclaimers, liability, dispute resolution, and interpretation.

Account deletion does not automatically create a refund right. Refund requests are handled by the relevant app store, subject to mandatory rights.

12 / General terms

The details that keep the agreement clear.

12.1 Changes

We may update these Terms from time to time. When required, we will provide notice of material changes and update the version and effective date above. Your continued use after the effective date means you accept the updated Terms, unless applicable law requires a different form of consent.

12.2 Governing law and disputes

Any dispute arising from these Terms will be handled by a court of competent jurisdiction, subject to applicable law and any mandatory rights to bring a claim in the courts of your place of residence.

12.3 Apple and Google terms

If you obtain the Service through Apple’s App Store, Apple is not responsible for the Service or its maintenance and is not a party to these Terms, except as required by Apple’s applicable terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them where permitted. If you obtain the Service through Google Play, your use is also subject to Google Play’s applicable terms and policies.
